The Civil Law Court at the Temple of Justice in Monrovia, has arrested and sent to jail, Hussein Fadiga for failing to satisfy judgement of the court to the tone of US$1.5 million in damages.
Hussein is the brother to the former Liberia Drug Enforcement Agency (LDEA) deputy director for operations, Hassan Fadiga.
The two brothers (twins) were adjudged liable for defaming the character of the LDEA former director-general, Abraham Kromah.
The court has since June 6, 2025, been in search of the defendants Hassan Fadiga and his brother Hussein, who were said to be hidden following the court’s ruling into the case.
On Monday, June 23, 2025, defendant Hussein Fadiga was arrested in Monrovia; brought to court and a commitment of detention at the Monrovia Central Prison was made to the sheriff of the Court, Humphrey P. Seequeh.
George W. Smith, Assigned Circuit Judge, Civil Law Court, told the Sheriff: “You are commanded to receive into your legal custody the living body of the defendant Hussein Fadiga, to be held until such time that the said defendant will have satisfied the judgment of the court. And it is hereby so order.”
Judge Smith early June, ruled against the Fadiga brothers for damages to pay the amount of US$1.5 million general damages to the plaintiff, and punitive damages in the amount of US$100,000 to serve as a deterrence of their “reckless, lawless, impolite and ill-mannered.”
Plaintiff Abraham K. Kromah on February 6, 2025, filed an action of damages for libel against defendants Hassan Fadiga, and a Hussein Fadiga.
Based on Plaintiff Kromah’s complaint, a writ of summons along with his complaint was issued by the Court sitting in its March 2025 Term, commanding the Fadiga brothers to appear on or before March 17, 2025, at 10 a.m., to answer to Kromah’s complaint filed against them,
and that their failure to appear, judgment by default will be rendered against
them; that defendants were further commanded by the Court to file their formal appearance and/or answers) on or before February 16, 2025, otherwise, judgment by default would be rendered against them.
Unfortunately, when the writ of summons along with Plaintiff’s complaint was served on the defendants on February 24, 2025, the service was greeted with defendant’s “uncouth, uncivilized, crude, disrespectful and lawless behavior.”
Meanwhile, the Civil Law Court sitting in its June Term A.D. 2025, issued a writ of Ne Exeat Republica against the twin brothers (Hassan and Hussein).
“Ne exeat republica” is a legal term, originating from Latin, meaning “let him not leave the republic.” It refers to a writ issued by a court to prevent the brothers from leaving the jurisdiction of the court, often to ensure they fulfill a legal obligation or to prevent them from evading a legal process. The writ, signed by Clerk of Court Victor G. Gailor, and issued under the directive of Assigned Circuit Judge, George W. Smith, prohibits both men from leaving the country while legal proceedings are ongoing.
The writ was issued following a petition filed by Abraham K. Kromah, the plaintiff.
In his filing, Kromah alleged that the Fadigas are preparing to leave the country “to foreign parts” in a manner that could be detrimental to his legal interests.
While specific details of writ remain unclear, the court determined that there was sufficient cause to prevent the respondents from departing the jurisdiction.
Hassan Fadiga is listed as the first respondent in the case, while Hussein Fadiga, known publicly as a social commentator, is named as the second respondent.
