Justice Gbeisay Disagrees With Ruling …Says Amended BoI Came Through A Backdoor By Yassah J. Wright

One of Supreme Court Associate Justices has thrown Monkeywrench in the Court’s April 23 ruling. Justice Gbeisay has outrightly distanced himself from the court’s ruling in the case surrounding the controversial removal of the embattled Speaker of the House, Jonathan Fonati Koffa. Koffa, is himself a lawyer by profession.

 In reference to the full Bench’s decision in the landmark case emanating from the House of Representatives (HoR) regarding its speaker position, Judge Gbeisay said: “My colleagues on the Bench have created a pandora box by leaving many questions than answers in the future.”

 Associate Justice Yamie Quiqui Gbeisay, gave his dissenting opinion on the amended Bill of Information (BoI), which he blames his colleagues of creating a pandora box by leaving many questions than answers.

This, Justice added: “Wherein, anyone who feels dissatisfied with Supreme Court opinions in the future will revert to the Court via the BoI to explain, declare or restate the Court’s earlier judgement.”

“I am therefore of the strong conviction that whether right or wrong, J. Fonati Koffa Bill of Information came to the High Court through an improper means or from the back door.”

He meanwhile, vehemently disagreed with the majority opinion.

In a dissenting opinion, Justice Gbeisay expressed his belief that the majority bloc’s actions from the House should not be disregarded and argued in favor of their position.

Despite his disagreement, the Court’s ruling stands in favor the Koffa camp.

In his facebook post earlier, Mines and Energy Minister Wilmot Paye said: “The Supreme Court of Liberia by its majority opinion today, (April 23, becomes the first supreme court in the world to render two separate opinions on the same matter.

This has made the quagmire in the legislature even more complicated, if not impossible, for resolution any time soon. How could members of the Supreme Court be more confused than the public?
